New Jersey's top prosecutor resigns after appeals court disqualifies her appointment.
Alina Habba has left her position as the chief federal prosecutor in the state. This comes after a judicial decision that challenged her eligibility to hold the office.
Acceptance of Resignation
US Attorney General, the Attorney General, announced Habba's resignation on the start of the week. In a statement that the judicial decision made it "untenable" for the official to effectively run her office.
"Let no one confuse adherence to the ruling as defeat," Habba stated. "This battle will now extend throughout America."
Court Ruling
The departure comes a week after a federal appellate panel determined that she had been unlawfully serving as the top prosecutor. This decision is likely to affect scores of prosecutions in the Garden State.
The appellate judges declared that a temporary posting that bypassed confirmation by the US Senate breached the Federal Vacancies Reform Act.
Ongoing Legal Battle
It was also stated that she will continue working within the DOJ as a top consultant. They intend to seek further review of the disqualification, aiming for a reversal.
In a statement, Bondi argued that the court "cannot be permitted to countermand the President's choice of lawyers responsible for executing the executive branch's core responsibility of prosecuting crime."
Accomplishments Cited
The attorney general highlighted her tenure and pointed out that under her leadership, the state capital of Newark saw a significant drop in crime. She also stated that the city of Camden had its initial homicide-free summer since 1974 free from homicides.
Legal Career
The 41-year-old attorney, first joined Donald Trump's lawyers in 2021. She went on to acted for Trump in his business records case in the previous year, which resulted in his conviction on 34 counts of document fraud.
Before Habba took on the top New Jersey post, Trump had revealed he was appointing her as his presidential counsellor in a potential future term, describing Habba as a steadfast ally and a dedicated fighter for justice.
